PREFACE

There are twenty-eight parts to this volume as the 1,450 documents reproduced here amount to over 14,000 pages. These 28 parts collectively comprise the companion volume to The Hauraki Tribal Lands, Parts 1-4 by David Alexander. This volume contains all the reference material necessary to support that report.

The reproduction quality of some plans and deeds is at a lower standard than would normally have been expected. This is because reproduction at the A4 size contained in this part of the volume is a reduction from the much larger size of the original document. Also the general condition of the original document may have deteriorated over the years : ink or pencil lines have faded; pages have been ripped, torn or are missing, and in some instances they have been damaged by water, fire, mildew or insects. The detailed references which are provided enable the reader to check the original source document.

The index to all supporting papers is set out in the preliminary pages found at the beginning of each part of this volume. A user guide is also provided.

USER GUIDE

The Hauraki Tribal Lands Supporting Papers, Parts 1 to 28 are over 14,000 pages of documentation relevant to The Hauraki Treaty Claims, and in particular the work of David Alexander who has researched the history of approximately 700 blocks of Maori land. These were the original Maori land blocks that were alienated mainly to the Crown and in most cases were subsequently sub-divided many times to form the present day pattern of land ownership in Hauraki.

Each document has been given its own unique identifier and has been categorised according to document type and the block of land or subject it relates to.

There are 23 different types of documents which have been labelled Section A through to Section W. These comprise deeds, files, Maori Land Court Minute Book records, survey plans, Certificates of Title, Land Registry Documents, Turton's Publications, Appendices to the Journals of the House of Representatives, Parliamentary Debates and Gazette Notices.

A copy of the main index is included in each part. The main index is organised as follows:

In this case we have three counter claimants, whose claims rill be considered in the order in which they have been heard.   /

let. Hori Ngakapa claims Kohatu-a-noa, and Te Mara-a-toishikaka. •two long narrow strips of land extending from the Piako river to the old boundary. through Timm forest. lion Ngakapa inserts that this land was the ancient territory of N'Tu, a section of Waitaha, whom he asserts to have been the ancient inhabitants of this district. tfp to this point liori's claims does not differ materially from that of the claimants, for he has not shown that he is descended from N'Tu. But he also claims that Tunioana, a son of &notao, had " mane over this, and on this point his evidence is not only exceedingly vague, but he altogether fails to show in what manner Tutnoana obtained the "mane" that he now seeks to prove. This question in of 'he greatest importance, since it is known to all that be had not an nii8eatral claim. and thereto. the Court cannot pre..e a right which has not been shown to exist, if ori Ngakapa thinks that Tullman& must have been related to N'Tu, but he cannot show the connection.

Boni Ngakapa denies that Waitaha and Maraca were ever conquered by the decendante of Marutuahu; he ensures the Court that he never heard that those tribes were burned in the where 8 "kumi" n length, that he never heard of their where till N'Maru mentioned it in the Kopuraruwai case, and that he has always heard from his old people that -Ts-lkapukapuka and Karihitangata were names for one and the same. outrage, in which the Uri—o-pou tribe were killed.

}Jeri Ngakapa's knowledge of the Waitaha or Mantua tribe is very. slight, but he tells the Court that he bee always known them under the name of Horoawatea, and that they owned this block of land. These are' the people whom he declares were never conquered. He, however, alleges that they were formerly protected by hie ancestors againetcontinual act.. of robbery and violence on the part of M'Maru, and as a proof of this protection he instances an affray called Takahiparu, in which the famous chief Te Taniwha interfered in favor of Horoawatea, against the Uringahu."hapu" of N'illare, and rolled the offenders in the mud.   •

It is quite possible that the Taniwha may have protected these: people, but mere protection would give Hori AO more claim over the Make, lands than the robbery and bounce of N'Maru would give that tribe \\a a right to claim it by conquest ; in neither case would the claim be valid Pease Tiunga, however, denies that either Te Horoawatea or Taniwha part in this affair ; according to him the affray took place between the. ..1.1rikarteka ^hapu" of N'Paoa, and the N'Maru, when the latter were rolled in the mud at Ngaroto, and not at Fiske, es stated by. Hari Ngakapa.: The point is not of importance, for as I have said, .Ifort Ngakapa could derive no title to this land by having rolled Nliaru in the - mud, nor could N'Maru derive any title from being rolled in the nand.

In this and other Piako cases nori Ngakapa has referred to the action of his ancestor, Te Taniwha, who, when certain of the Piako lands were sold to Mr McLean, succeeded in persuading the Government to relinquish the purchase, and he tells LS that it was the "mama" obtained by this action that enabled him subsequently to hand over all these lands to Tawhiao.

Here it is also possible that the talc told may be true, for only a chief of Te Horeta's rank could have dealt effectively with the Government, but the evidence is only that of "mina," not of right to the land ; and as for II ori giving the land to Tawhiao, he knows, and the Court knows, that any "mans." he might have had over this land was derived from the owners and that had they not consented to the gift it could not have been inside., The " mama" of any liangatira over land is confined to that owned by himself and immediate relatives. Ile has none over the land of his tribe except by their consent.

The evidence amounts to no more than this, that Hai Ngakapa has occasionally resided et To lierepel,i, Inn it is nut clear that lie 1104 ever done more than visit the land ; most certainly he has never resided permanently on it He claims the land for I"Nu and Tumoana, but he does not show that which is essential in this case, vit.: how Tumoana obtained a right ; nor does be show that he derives any claims from N'Tu,

whom he admits to be the real owners.

There ia no reason to doubt that Tumoana may have lived on terms of friendship with NTu and N'Manithiri, but no valid title could be derived from that fact. Something more than that must be shown to

justify the Court in awarding land to descendants of Tumoana, more especially when it is shown that they have not resided on the land for -two generations at least.   •   -

'" It seems to the Court that this case has been set• up by Mori   • Ngakapa foiUno other reason than that his mother's brother, Te &demons, kept pigs and lived at or in the neighbourhood of gohutuanoc But we are not told by what right Te Iletemona did this. Paora Tiunga says he never heard that he had a right But even though it were proved that he had, it does nottullow that this right descended to Mori Ngakapa

It is not denied that To Taniwha lived at the Kerepelai on his own land, and it follows as a natural coneequenoe that he would have great power over the Iloroawatea tribe in the vicinity, for ho was one of the

  • great chiefs of New Zealand. But this "mama" would be over the people: -and not over their land. Had it been intended to reward' Tumoana, Te Taniwha, or any other chief for anything they had done, a formal gift of land would have been made. Apparently nothing of this sort has been , done, and, therefore Hori Ngiskapes case is in this position, that he claims the land of a tribe to whom he liaa shown no relationship.

In the opinion of the Court, Tumoana and his descendants have never ' hisfany right to this land, and it has not been shown that Hon Ngakapa is connected with any of the other ancestors to whom he admits the' land belonged.   -

'some ;points Ts Raika supports the 'N'Hako evidence 'wary strongly. Tor instance, he says that neither Waitaha nor 'Harems' were ever conquered. He denies that Tiu Pirihi or Mantes .were wver slava, and he says, .1 have always heard Mama spoken of as .tuatine.' " He asserts that he never heard of any gift by 'Nerohura' to the N'Maru ; in fact, he, one of the leading chiefs of N'llana, has-not ' heard any of those things concerning which Taipari is so confident.

Taipari asserts that all the people on the -Make lands were his slaves, yet Hare Renate says the N'Tehure lived on Nonkourahi, and were not slaves.

Te Raika and Hori Ngakapa tell us that N'Ilfanuhiri owned Ngataipuit and Xopunralli, and were not slaves. Herr Ngakapa and Tailiati Paetai us that N'Tehurs lived at To Korepehi, and were not sieves. And lest, but by no means least, Pains Things. gives a genealogy showing that all of these lupus:" were from Hake, and not from the fabulous Waitaha and Marama, . so often referred 'to' by N'Marn, and concerning whom they know so little. The Court

  •  opinion that the ancestors of le Rails may have lived occasionally at Plaice, 'but that ouch residence .gave them no title to the lands so

Occupied.

. This claim is therefore dismissed.

"---The third claim is that of N'Maru, who on this occasion do not claim to be entitled to all the 'land, as is usually the case. They claim by virtue of a conquest. which the Court has already decided never toots place—a. conquest • that . has been denied by almost every witness examined since the Court gave its judgment in Konkouralli.

The' Court has given its reasons for believing that there never was a conquest over the Piaku hinds, and ham seen no reason for altering its mind on this subject. Indeed, every succeeding case has shown how correct that judgment was, and how unlikely it 'is that it will ever be reversed.

"• Although this is the view the Court must take in this ease, Hong the lees it .will consider the evidence given by the N'Maru witnesses. At the very best the evidence amounts to no more than this : that for the last 70 year. the. N'Maru .have really exercised no rights over these Piako lands, other than those which tribes having no rights at all might well have exercised.

Their claim is that they were in the habit of catching eels and patiki in the Piako River, and that a few (probably not more than- half-a-dozen) of their people lived on the land and ran pigs on it. Now, -there is nothing before the Court to show that these few

man . of N'Maru were not related to N'Manuhiri, who are admitted .by. * - all •to have been the real owners of the land ; end there is absolutely, nothing' that would. justify the Court in assuming that they had any titer right to the land.
