PREFACE
There are twenty-eight parts to this volume as the 1,450 documents reproduced here amount to over 14,000 pages. These 28 parts collectively comprise the companion volume to The Hauraki Tribal Lands, Parts 1-4 by David Alexander. This volume contains all the reference material necessary to support that report.
The reproduction quality of some plans and deeds is at a lower standard than would normally have been expected. This is because reproduction at the A4 size contained in this part of the volume is a reduction from the much larger size of the original document. Also the general condition of the original document may have deteriorated over the years : ink or pencil lines have faded; pages have been ripped, torn or are missing, and in some instances they have been damaged by water, fire, mildew or insects. The detailed references which are provided enable the reader to check the original source document.
The index to all supporting papers is set out in the preliminary pages found at the beginning of each part of this volume. A user guide is also provided.

USER GUIDE
The Hauraki Tribal Lands Supporting Papers, Parts 1 to 28 are over 14,000 pages of documentation relevant to The Hauraki Treaty Claims, and in particular the work of David Alexander who has researched the history of approximately loo blocks of Maori land. These were the original Maori land blocks that were alienated mainly to the Crown and in most cases were subsequently sub-divided many times to form the present day pattern of land ownership in Hauraki.
Each document has been given its own unique identifier and has been categorised according to document type and the block of land or subject it relates to.
There are 23 different types of documents which have been labelled Section A through to Section W. These comprise deeds, files, Maori Land Court Minute Book records, survey plans, Certificates of Title, Land Registry Documents, Turton's Publications, Appendices to the Journals of the House of Representatives, Parliamentary Debates and Gazette Notices.
A copy of the main index is included in each part. The main index is organised as follows:

Mr El.g.L.Kenrick holds a Charging Order over the above Block for C213..1.6.for Survey fees.
'The Court has since divided the Block into No:12,803,and apportioned the Lien over the three blocks.
The Government have paid the amount on No:2 Block which they bought and the Natives paid the amount due on No:3 block.
The amount due on No:1 Block is £71,0:6.and the Government are purchasing this block and I am'given.to understand have purchased interests equal to £60'of the amount due,but there will be much delay in getting the balance of the interests from the Natives in consequence of some being infants and for other reasons.
I took all the `necessary. steps for selling the block 'and the ...... notices were given to the Government; As there is little chance of tho Government paying-the above lien of £71.0.6., for a long time if they wait to stet the balance of the interests from the natives,I shall feel greatly obliged if you will see if the

It is or the utnost importance that we should se--cure those parts of the blocks which t re dovetailing into the area or swamp lend which we propose to reclaim and if it should be found necessary therefore that as high as IN-should be paid for Puhangateuru Block it Will be profitable for Government to acquire it,but I do think that if you authorise Captain Hair the Land Purchase Officer to pay as high as 7/6 for PuhangateUru lands and say not exceeding 6/-for Otakawe lands he will be able to acquire them at that price.
The Otakawe Block is not comprised in the first scheme of drainage,but the Puhangateuru Block if not acquired trill greatly hamper if not altogether spoil the carrying out of the drainage scheme.

AN IMPORTANT DECTSIfiN.
Ouft readers will see. in perusing the report, published elsewhere, of the Native (Titles) Validation Court, held before Chief Judge Davey at Short-hind yesterday innrnitig, that a very important point was decided, which arose through an application made by the Kafiri Timber Company for the validation of an old lease which gave the company considerable privileges in j connection with timber, etc., on the Kuaotunu No. 3 Block, of 1800 acres, at Mercury Bay. The applicants based their claim principally on the ground that a lease had been ceded them for which consideration had been given, but it appeated any agreement entered into was set aside by a later deed con- veyin7 the freehold rights of the Klock to the Crown for £2090. Certainly the. deed on the one part was not signed by all the owners, but Captain :hair showed that only one name, ,,as missing, and that that omission was due to the death of the native. Apart from this right the Crown had acquired it was contended that by an order of the Native Land Court the block has been set apart for mining purposes under clause 16 of " The Mining Act, 1892." This clause, it. will be. remembered, says in effect that on the investigation of title the Land Court may, with the consent of a mojfirity of the native owners, order the whole or any portion of a block of land to be ceded to the Crown for mining purposes. It was therefore contended that as the cession had been made the Crown had the precedence, and again two or three clauses in the Validation Act were quoted to show that the interest of the Crown was to be taken ati paramount and the Court could not in any way prejudice its interests. The. Company's counsel endeavoured to prove that the Crown's right would not be interfered with if the application wa-s gra ntcd, bu tpast actions were. brought forward to show that the. Company had always looked askance at mining operations and had gone so far as absolutely- to prohibit miners working in the locality at all. The judgment' as given in our report was entirely against the applicants, the !Court considering and we think rightly that the Crown conveyance stow 1 preeminent. Most people will agree with us, that milting operations must he encouraged and not retarded, and also , with us will hail the decision of the Court with satisfaction.

The humble petition of The Kauri Timber Company 12c1 1,heweth:-
That the petitioning Company is a Company duly incorporated in the Colon of Victoria but has invested in the Colony of New Zealand in the purchase' of Timber Mills and Timber properties upwards of Six hundred thousand pounds.
That one of the properties so purchased was a lease of a block of land called Kuaotunu No.3 containing 4810 acres with the full right to cut and remove all the Kauri and other timber trees thereBnom.

That the title of the said land investigated on the 1st day of October 1883 under the provisions of "The Native Land Act 1875 and an order for the issue of a Memorial of Ownership under the provisions of the said Act was afterwap4s such investigation duly made in favour of the Natives who according to the Native Custom were the owners of the said block.
That after the title to the said block of land had been so investigated as aforesaid the Native owners thereof by two deeds dated respectively the 25th day of August 1885 and the 18th day of September 1385 sold to one William Meikle of Mercury Bay in the Provincial District of Auckland all the Kauri and other timber standing upon the said block and by the same deeds demised\_and leased the land for a term of 21 years and granted all the nesessary rights for the removal of the said timber.
That after the said deeds had been executed as argyle-said the same were lodged in the Native Land Court for an inquiry and Certificate by a Judge of the said Court under "The Native Lands Frauds

That such inquiry was held and all the Natives who had executed the said deeds were duly notified of the time and place appointed for such inquiry and the Judge presiding at such inquiry was Mr E , W. Puckey, a gentleman thoroughly acquainted with the maori language who, after satisfying himself that the deeds had been executed by all the fiNtive Owners with the formalities required by law, and that they there thoroughly understood the purport and effect of the same, and that the consideration expressed in the deeds had been duly paid, certified to the bona fides of the transaction on the 30th day of April 1887.
That the application Vor such Certificate and the result thereof were duly filed in the Native Land Court Office at Auckland with the papers connected with the said block and became records of the said Court.
That at the time of the execution of the said leases by the said Native Owners there were no settlements on the said land as it was of very poor quality and almost inaccessable.
That'on the 1st day of September 1888 the said William Meikle by Deed duly. executed sold as4-signed and transferred to the said Com-

pany all his interest in the said leases and the Kauri and other timbers and it was then considered that as the deeds of lease and sale of timber had been executed by all the Native Owners and the transaction had thereafter been inquired into and found bona fide by a Judge of the Native Land Court that the title of the said William Meikle was perfect.
That from the time of the purchase of the said leases and timber by the said Company and until there were rumours of gold having been found in the district in which the said block was situated the title of the said Company to what it hadApurchased and paid for was never questioned:
That in the month of September 1889 and after the purchase' by the said Company the question as to what formalities must be com.;:lied with in dealing with lands for which Memorials of Ownership had been duly ordered to be issued under "The Native Land Act 1873" was first raised in the case of"Poaka versus Ward" and the appeal from the decision then given was delivered on the 28th day of February 1890.
That it was by the said case decided that a strict compliance .

That there would have been no difficulty in obtaining such completion as the same inquiry which satisfied a Judge of the Native Land Court as a Commissioner under " The Native Lands Frauds Prevention Act 1881" of the bona fides of the transaction would have enabled him to certify as to the completeness of the transaction as required by '"`.'he Native Land Act 1873Tr.
That there was no opportunity of rectifying the error that had occured in the non-observance of such formalities as "The Native '-Lands Act 1875" and the amendments thereof were repealed by tThe Native Land Court Act 1886" which was passed on the 9th August 1886 and came into operation on the first of October of the same year- a period of three years prior to the final decision in the case of "Poaka v Ward".
That during the period intervening between the passing of "The Native Land Geurt Act 1886 18731' and tilie its repeal by"The Native Land Court 1-1.;:t 1886" a very large number of dealings had taken place in respect of lands held under Memorial of Ownership and in very few instances had the formalities and technicalities prescribed by -the first mentioned Act been complied with although a great number of Certificatee. of Title under the Land Transfer Act had been issued to purchasers for

That after the repeal of "The Native Land Act 1873" and the publication in the year 1890 of the decision of the Court of Appeal in

the case of Poaka v Ward many bone fide purchases like the petitioning Company were unable to complete their titles and to remedy the grievous wrongs that would be thereby occasioned an Act intituled " The Native Land (Validation of Titles) Act 1893" was passed on the 6th day of October 1893 coming into operation on the 1st of January 1894 and the reason for the passing of the said Act is fully set out in the preamble thereto.

That during and about the years 1892 and 1893 applications were made by Miners and others for permission to mine upon this and other blocks of land owned by the petitioning Company and overtures were Vien made by the then Minister for Mines for the purchase or acquisition of those portions that had been cleared of timber.
Tha, the position taken up by the petitioning Company in respect to this block of land then was well known to the Government not only from verbal communication but copies of the said leases had been forwarded to the late T. W. Lewis the Under Secretary of the Native Department at his own request and particulars of the contents had be:m supplied subsequently to Mr E. W. Northcroft when Warden of the Hauraki. Mining District for the information of his Department.
That up to this time the said land had not been as far s is known to the petitioning Company ceded by the Natives for mining purposesAor was it, within the area declared open for mining by "The Auckland Goldfields Proclamation Validation Act 1869" and it was not until the 27th October 1892 that an aplication was made under the 16th section of "The Mining Act Amendment Act 1892" that the land should be declared open for Mining by reason of the cession of the same by the Native Ownia ers for that purpose.
That at the sitting of the Native Land Court held for that purpose a telegram was despatched to the Judge thereof informing him of the existence of the leases and Mr H. W. Northcroft who was made then acting as Warden and who made the application on behalf of the Government also sthted that he knew that such a lease was in existence.
That the Government obtained an order declaring that the land had been ceded for mining purposes on the 17th of July 1895.
That up to and long subsequent to this period negotiations had been pending between the Government and the petitioning Company as to the opening for mining purposes of certain of its cleared lands in - the Cape Colville Peninsula but with no result and on the 30th day of March 1895 the petitioning Company caused to be lodged in the Office of the Native Land Court at Auckland an application under the Native' Land (Validation of Titles) Act 1893 for an order of the Validation ,Court validating the leases granted to the said William Meikle.

Ong Company had not received any information from the Government as to the position the Crown or the Ministers representing it intended to take up but was under the impression that the only question at issue was obtaining mining rights thereon.
That at the hearing of the said application the petitioning Company was duly represented and had in attendance numerous witnesses who were prepared to testify to the bona fides of the leases to the said William :Ieikle and to the Natives never having expressed any dissatisfaction until the Land Purchase Officer of the Government had been among them and had pointed out that they would obtain if the land was thrown open for mining'.
That the validation Court was presided over by Mr G. D. Davy Chief Judge of the Native Land Court and Captain Gilbert Mait, Land Purchase Officer for the Government represented the Crown and before the Counsel for the petitioning Company was able to open his case and produce evidence in support of the application the said Gilbert Mair rose and stated that he had been instructed by the Government to appear and oppose the said application under section 11 of "The Native Lands (Validation of Titles) Act 1893" as the Government had since the leases were executed•by the Natives obtained deeds from them ceding the land I for mining and had also purchased a large number of the Natives interests, that the Crown claimed to hold the land free from any lease and that therefore as the Court could not proceed with the application without in the words of the section calling in question the title of Her Majesty to land claimed by the Crown, the Court had no jurisdiction and the application must therefore be dismissed and in verification of his statements he produced certain deeds executed by the Natives.
That the Counsel for the petitioning Company urged upon the Court the extreme injustice of the position taken up by the Government in thus seeking after full knowledge of the petitioning Company's purchase to prevent it from obtaining what it had fairly and honestly acquired before any negotiation had been entered into by the Government and implored the Court to at least allow him to call his evidence in or-
der thet the same could be laid before the Government so as to enable re
the Ministers and other responsible persons to reconsider to/consider
the position before the matter was finally settled.
That upon the said Chief Judge appealing to the said Captain MairAs to whether he would agree to this course being adopted he stated

,he was unable to do so, as the instructions he had received from the Government to oppese the application ware peremtory and that the objection therefore could not be withdrawn.
That the said Chief Judge then stated that he had no alternative but to dismiss the application as under the position taken up by the Government, he had no jurisdiction to entertain it, as in his opinion it was only necessary even without the production of any deeds for the title of Her Majesty to be asserted to compel him to dismiss the application.
That the whole of the said block with the exception of 513 acres reserved for the Natives has now been declared Waste Lands of the Crown and the Crown Lands Commissioner at Auckland has taken possession of and branded all the timber standing thereon.
That the petitioning Company has through the action e€--the a.c.t.irwit taken by the Government been deprived of six million superficial feet of Kauri timber without including in this estimate a large quantity of other timber.
That the petitioning Company respectfully submits that advantage should not be taken of an..omission on the part of William Meikle to comply with a mere technicality.
That the petitioning Company respectfully submits that the Government has not be,:n justified in the action it has taken, whereby Company has been deprived of the timber standing upon the said land without providing for the payment of compensation.
14herefore the petitioning Company humbly prays that your Honourable House will be pleased to take the facts hereinbefore staled into their most favourable consideration and will direct:-
That the Kauri and other timber of which the said Company has been so deprived shall be restored to it, together with all rights to ,cut and remove the same as granted by the said deeds of lease, or
That an equal quantity of timber situated elsewhere of the same value having regard in this respect to the cost of delivery to tidal water be granted to the said Company together with all necessary rights of removal or:-

Some three or four weeks ago the'GOvernmenV purchased from one Katerina Hauruia her block of land No.2a and No.1 including a piece of ground, area about ten acres more or less where she has lived as her homestead for a great many years, but according to the e& lady's wish, the Warden Mr R. S. Bush reserved her the first liberty and rights to forward you the enclosed application praying you will take the necessary seeps at your earliest convenience to grant the said ten acres more or less under the Crown Lands Act, and also without your aid in the matter the old woman would be left powerless and homeless. I was asked by Mr R. S. Bush Warden, to forward the enclosed form on her behalf. I: called into your Office a few days ago while I was in-town and the kind gentleman'tn charge gave me the enclosed form to fill in and rettrn by post to you, hoping it will find you in good health and spirits, I. take the liberty by asking you to appoint Mr Riney of Coromandel to Survey the said parcel of land on behalf of Katerina .Mould this meet with approval at your good hands. The old lady's house is situated and standing upon the foregoing land applied for.

Referring to our conversation with you the other day, we wrote to Captain Mair asking him to be good enough to send us the 324:4:3stated to be in his account and have now received his reply, a copy of which we enclose you.

Referring to that part of Captain Mair's reply which says that Mr.Cheal is bringing forward some claim in The Native Land Court, we have seen Mr.Cheal about it and the latter gentleman tells us that any action he is taking now at the Thames is with regard to recent lien*, but, bas nothing to do with the Piako judgment, and that as the Government is now moving in regard to Piako judgment, he, Mr.Cheal, does not intend to interfere in
any way in the matter.

Norz.--Officers employed in the Public Service are required to alter the Certificate as occasion may require before signing it, taking care that it is so worded as to afford assuranoe that the conditions upon which in each case.the payment of the claim depends have been completely and satisfactorily fulfilled, thus :—
When the expenditure is incurred under a CONTRACT, it should be certified " that the charge is according to contract, and that the service has been satisfactorily performed."
In claims for Summits, add, "The supplies have been duly delivered, and are entered in my • Deenctuitmental Property or Stores for Issue Return for the
,1 ."
In claims for Poor, or PPXONNTS to Natives, add, " The supplies have been delivered to the Natives for whom they were obtained."
In claims for Tasvitraseta-ussableas, insert, " I was travelling on the Public Service during the period for which the claim is made."
In claims for Fosses, erase the whole certificate, and insert, "I certify that I actually kept a horse for the Publics Service during the period for which the claim is made."
In claims for any other service, add, " The service has been duly performed."
Officers certifying abstracts will be held responsible for all errors in computation (Section 63 of " The Treasury Regulations"). They are requested to observe that unless the foregoing instructions are strictly complied with the Audit Office will be linable to pass the a000lpt.

We wrote you on the 28th.May a letter, copy of which we enclose, but have not had any reply thereto.
Mr.Cheal has asked us to write to you at Gisborne again, giving you the details of what is known as The Piako Judgment, in which Graham and Cheal recovered judgment against a great many natives for a large sum of money, of which all has now been paid except the small balance of 2192: 4: O. The balance is arrived at in this way -
Judgment was entered on the 19th.December 1895 and Supreme Court judgments all carry interest at 6%, therefore we can state it as follows :-
