PREFACE

There are twenty-eight parts to this volume as the 1,450 documents reproduced here amount to over 14,000 pages. These 28 parts collectively comprise the companion volume to The Hauraki Tribal Lands, Parts 1-4 by David Alexander. This volume contains all the reference material necessary to support that report.

The reproduction quality of some plans and deeds is at a lower standard than would normally have been expected. This is because reproduction at the A4 size contained in this part of the volume is a reduction from the much larger size of the original document. Also the general condition of the original document may have deteriorated over the years : ink or pencil lines have faded; pages have been ripped, torn or are missing, and in some instances they have been damaged by water, fire, mildew or insects. The detailed references which are provided enable the reader to check the original source document.

The index to all supporting papers is set out in the preliminary pages found at the beginning of each part of this volume. A user guide is also provided.

USER GUIDE

The Hauraki Tribal Lands Supporting Papers, Parts 1 to 28 are over 14,000 pages of documentation relevant to The Hauraki Treaty Claims, and in particular the work of David Alexander who has researched the history of approximately 700 blocks of Maori land. These were the original Maori land blocks that were alienated mainly to the Crown and in most cases were subsequently sub-divided many times to form the present day pattern of land ownership in Hauraki.

Each document has been given its own unique identifier and has been categorised according to document type and the block of land or subject it relates to.

There are 23 different types of documents which have been labelled Section A through to Section W. These comprise deeds, files, Maori Land Court Minute Book records, survey plans, Certificates of Title, Land Registry Documents, Turton's Publications, Appendices to the Journals of the House of Representatives, Parliamentary Debates and Gazette Notices.

A copy of the main index is included in each part. The main index is organised as follows:

Re Valuation of Waltakaruru Blocks.

•      In compliance with your request for a valuation of the above blocks, I crossed the Hauraki Gulf in the Government launch last reek and made an inspection on the ground, and now beg to report as follows:-

Waiitakaruru No.1D: this section consists of broken /ally spurs, with soil of generallj poor quality. The vef!etation is mostly fern and scrub, but there are a few patches of liqnt mixed bush in the ;7ullies. I do not consider that it would pay the Crown to Rive more than 7/64 ner acre.

Waitakaruru Noik: Consists of about one-third rauno swamp and good flats , the balance running up into spurs of poor quality. The growth is mostly fern and scrub with some patches of mixed bush. There are about forty acres of kahikatea on the flat which contains a little milline timber. From the shape of this block it would lend itself well to cutting up into about half a dozen farms, Riving each a fair piropowtion of the good and poor land. I consider 15/-per acre would be a fair avera:;e price to ;five for the blook.

VaitWkaruru Nos.3C No.2 & Mo.3B: These each con-ist of about half good rauno Pwarau, the balanoe   un into poor clay spurs covered with fer i and scrub. Average value

Waitakaruru No.5B: The best parts of this block consisting of about 3,700 acres nave been leased to Europeans.

In a previous report I stated, from a general knowlede of the cuntry, that. I eoanidered the balance worth iron fi/- to 10/- per acre, but on a close insnection I do not consider that it: would na t) ,ive more than 7/6 per acre. It runs up into broken cla- spurs, and during the heavy rains which we exnerienced in January last an immense number of slios took place.

Waitakaruru    eonrists of :calf swawn and good swamis flats, the balanoe broken to sopewhat undulating to somewhat broken alon:t the norteern boundary. The growth on the swawp is a mixture of titres, flax, wiwt. toetoe So, and a patch of small kahikateo. On tact dry iround the growth

la fern and scrub.',"here ie i clearin., of about 20 acres in rough grass and a snail shanty.

In comparison with other lands we are purchasing £l per acre would be a fair average valuation, but as the acquisition of this land is rather important in connection ,Pith the drainage operations in the Piako, I would recommend going as high as 25/- if it cannot be got for lees. Waitakaruru No.    

This is the block on which the ;Aaoris are chiefly residing and have their cultivations.

I would recommend thot it be reserved as a pans kainga for thew.

of land required for the Waitakaruru Canal in the Hauraki Plain: to be taken under the provisions of section 9 of the Hauraki Plains Act,1908. It is proposed to take in addition to the land actually required for the canal four of the sever:1 portiot of ;ot. 1 D.P. 7617 comprising 4-3-21 and to make the new canal the eastern boundary of this lot between the points marked in pencil "A" and "B" on plans. These acquired severances could be included with the Crown land to the east of the old stream bed and advantageously disposed of to the holders of .the adjoining section. With reference to your memorandum dated 13th

April last, i9415, I have to inform you that the Departnmnt's application for assessing the compensation payable for 1 acre 3 roods 33.7 perches taken from Waitakaruru 2F Block by proclamation published in Gazette of 11th August 1921 ,was heard by the Native Land Court at Thames on the 22nd ultimo, when the sum of 015/0/0 was awarded.

As soon as the Court's Award has been received it will be forwarded to you in order that your Department may make arrangements for the compensation to be paid to the persons entitled thereto.

The information for Piako County is supplied by Mr. J.B. Thompson, the blocks he reports as being specially advisable to purchase are so noted on the schedule. The blocks in Ohinemuri and

V Thames Counties are all recommended by Mr R.D. Raszard as being advisable to acquire. Those blocks noted as requiring draining are not immediately fit for settlement, but would work in with the Piako Drainage scheme. Tauranga County is reported on by Crown Lands Ranger tensington . Mr. Allom reports that very little of the land in Opotiki

The Ranger reports that Mr Jas Hawke is at present cutting and removing the Kauri Timber therefrom and who claims that he purchased the timber from Mr Dsraoh who acquired such right from the Natives considerably .prior to the Crown purchase. Purchase of NRatainuaa No.   Block.

The above-mentioned block was purchased under the Maori Land Settlement Act, 1905, but the purchase has not been finalised owing to the loss of the Transfer frail the Native owners.   Consequently the land is still legally Native land and as the Department cannot give title until proclamation as Crown land is effected, the matter has recently been investigated with a view to finalisation.

It appears that part of the purchase money was paid to the Receiver-General's Deposit Account because some of the Natives could not be located and it has been ascertained that there is a balance of £30.2.10d due to sundry sellers.   The Secretary to the Treasury advises that seeing that the original payment to Public Account was made in 1908 this credit cannot now be traced and in order that payment to the remaining native owners or their successors may be effected it will be necessary to take an item on Vote, Lands and Survey.

Your approval is therefore requested to the insertion of an item on the current estimates for £30.2.10d in this

Crown Purchases - Ohinem Ohinemuri and Aroha ourvuy

A survey has recently been made of Sections

184-189 Block XV. Ohinemuri S.D. to enable a subdivision and transfer of two existing leases from the Crown to be registered.

On examination of the plan it was found that one of the origins blocks underlying the subdivision is Ohinemuri 7R2 containing 54 acres. There is no registration of this block with the District Land Registrar, and according to the Native Land Court file, the land is still held under native ownership.

On investigation of the whole of the purchases of Ohinemuri Block, it is found that tOe same position applies with regard to Ohinemuri 16.2\_1:n Blocks I. and II. Aroha S.D. and containing 452a.2r.00p.

Both titles are held under Partition Orders dated the lath October,1887.A,

I should be grateful if a search could be made of your records to discover whether either of these subdivisions was ever purchased by the Crown.

Ohinemuri 7A2 is shown as native land on compiled plan 3416 from which the Crown's title

for 7A1 issued. The plan of 7A comprising 157 acres, has been coloured as other areas of Crown lands on the same plan, although it has a note indicating that only 110 acres (now 7A1) was gazetted Crown land, Gazette

I would refer you to previous correspondenc ..7.eEarding the above sections on your files 22/832 and 22/3 9. On 10th September, 1943, you advised that the Hon. Minister of Lands had approved of the subdivision. of the above sections held by Mrs. A.J. O'Neill and the transfer of portions to

C.L. Gardiner and C.E. Hollis. Following this approval a subdivisional plan was received in this office whereon the sections were redesignated as lios.18).1 to 189 (inclusive)

Block XV Ohinemuri Survey District.   Investigation of this
plan raised the question of the Maori ownership of the under-- lying Block - Ohinemuri 7A2, and the issue of subdivisional leases in the name of Mrs. O'Neill was held up pending further

investigation.   It was originally intended that part of the
land should be transferred to C.L. Gardiner and part to C.E.

Hollis.   The parties were informed through their Solicitor
that issue of subdivisional lease 5; was delayed rending investigation of the status 6f the land.

One of the parties, C.L. Gardiner, applied in November 1944, to transfer his portion to F. and A.M.Clark, and the Hon. Minister of Lands approved of this transfer on 17th January,1945 (yourfile 2Z/832): approval was provisional pending the clarification of the status of the land.

On 7th June last this office was advised that the other original transferee, C.E. Hollis, had bought another piece of land and that the Bank required to take collateral security over that area purported to have been transferred

to him from Ers. O'Neill.   The Solicitor acting requested

that the Title should be issued without further delay.   He
was informed that the matter of the Crown's title to the entire area was still being investigated with the Native. Department, Wellington.

I now forward herewith a copy of the latest communication received from the Solicitor and from this you will note that the matter of issue of subdivisional leases both to Gardiner and Hollis, the original transferees, is of extreme urgency on account of the dealings. which have taken place since the subdivision was approved.

On 23rd ultimo this office communicated with you regarding the ownership of Ohinemuri 7A2 Block and pointed out the position in regard to the successors in title to the original Maori owners. As the matter of completing title is now one

Thank you for your above memo and the Deeds, which I enclose Ji herewith.

In addition to the two Tarsus mentioned in Deed 1460, there is one referred to in Deed 1461. Although there is a large discrepancy in area (12 acres in Deed and 45 acres on survey) old plans and field notes indicate that the Maungawhia Tapu and Te Pahi are one and the same. Maori graves are situated in such positions that the 12 acres mentioned in the Deed would not contain them and the surveyor stated in his field book that he therefore had to cut out an area of 45 acres 1 rood 29 perches.

The original descriptions of the blocks containing, or in the oase of Deeds 1460 and 1461., excluding,these Tapu areas are as shown in the above heading, but No.1 was also known as Ngatitaharua, No.17 as Ngatitoki or Ngatitamatera and No.18 as Ngatirahiri.

Subsequently areas called Ngatitaharua Reserve, Ngatitoki Reserve, Ngatitamatera Reserve and Ngatirahiri Reserve were gazetted Crown Land, but these areas should not be confused with the Tapus, as they are the areas which the above Deeds stated should be the subject of Crown Grants to certain Maori Owners.

In the light of data found, and unless you are able to find further information, I recommend that the areas 2 to 7 inclusive in the schedule attached to the Chief Surveyors memo of 16 February 1973, be vested through the Maori Land Court in the owners beneficially entitled.

Please advise if you concur.

Her interests in the Ongarehu Block is apparently 3 roods (1A) share) which I'estimate is worth £45 and the two sections in Kaihere Village total 0A,2r,24p,and are worth about £35,sc that the exchange would be a very satisfactory one for the Crown.

As the Ongarehu Block has been taken-Gazette

78-1920- page 2580-and the compensation is yet to be assessed I would suggest that this offer be forwarded to the Public Works Department with a request that the Land Purchase Officer give it immediate attention.

In reply to your memo of the 31st,inst., I have to state that at present no use is being made of this block.

About 12 months ago some of the willows were removed and 41. commencement was made with the draining but all work was discontinued when the petition was lodged by the Natives.   •

The huts have not been interfered with and are now occupied by the Natives. I have to point out however, that the Natives   only commenceAto occupy these huts when the acquisition of the land by the Crown was first proposed.

A site for depot and workshops at Kerepeehi is absolutely essential and this block is the only suitable site with water frontage available. Two thirds of the block will be sufficient for the purpose and the huts could easily be'removed to the back portion. The land is not ring-fenced,stocked,or cultivated.

With reference to the taking of this block by proclamation, under .the Public Works Act, I have been advised by the LocalEngineer, Mr.B.Taylor, that an attempt

was made by some Natives to prevent the carrying out of IP

operations on the Block.

Mr. Taylor hatinstructed a gang to do certain work on the Block but their presence was objected

  • to by the one time part owner, a Maori woman named Peneti

  • Meanie,   It is stated that she secured their departure from the property by brandishing an axe, pulling up pegs and striking horses with a post.

Mr. Taylor interviewed the Native woman and spent two fruitless hours with her, endeavouring t4 explain the position. She, however was not to be induced to allow the men on her land and the Engineer then asked the resident constable at Kerepeehi to interview her. The Constable approached the Native but was received with a blow on the side of the head. The police then brought an action against the Maori woman for assault and trespass on the land. For the assault she was fined £5 and costs, and bound over to keep the peace. On the charge of trespass the case was dismissed, the following being the Judas reserved judgment..

"The defendant" the magistrate said, "is one of six native owners of a block of land situated at Kerepeehl, containing four acres and two roods more or less,and known as Te bata-a-to-kawau Block. In or before the year 1920 the Minister of Lands, in pursuance and by virtue of Section 9 of the kiauraki Plains Act,1908, and Sections 18 to 25 inclusive of the Public Works Act, 1908 decided to take this particular block of land for the purposes of the former Act, This action

appears to have been resisted by the native owners, wie   • ultimately petitioned Parliament in the matter but this petition was apparently dismissed, fors proclamation dated the 31st,day of August 1920, was gazetted on the 2nd, day bf September 1920, vesting the said lands in His Majesty the KinG-on and after the 18th,day of September 1920. Bomb time•thereafter a Compensation Count, consisting of.s. Judge of the Native Land Court and two assessors,sat to determine the amount of compensation payable to the native owners in respect of the taking of this block but it was not until December 1921 that the amount of compensation was fixed at £500. The defendant swears that the

  • received no advice of the amount of -compensation so fixed,and that she has not been paid the money noreny part thereof,and she disputes the right of the Department by its aervants to enter on the said lands.

"In January 1922,Mr.E.Taylor, the engineer in charge of certain public works at Kerepeehi,received instructions from his Department to commence work on this block, and he ordered his men to commence work accordingly. The defendant thereupon obstructed the Department's Workmen, belaboured the Department's horses with a picket, and committed at. least one assault. She is now,

1 charged under Section 6,Subsection (.c). of the Police Offences Act,1908. That Sub-section reads as follows.-

*6(c).Every person is liable to a fine of zlo or to imprisonment for any term not

exceeding three months who wilfully trespass

in any place, and neglects or refuses. to

leave such place after being warned to do
. so by, the owner or any person authorised by

or on behalf of the owner.'

"To constitute the offence under this sub-section there must have been first a warning to.leave given to the defendant by the owner Or any person authorised by or on behalf of the owner and,second,a neglect or refusal by the defendant to leave after receiving such warning.

With regard to the first point,as.to the alleged warning issued by the engineer in chargeOtr,Taylor,snose object at that time was to pacify an extremely violent and frenzied native woman so as to permit of his men getting on with the work inrormed the defendant according to his evidence ,that she could remain'on the land a

'reasonable time if she did not interfere with his men. He also offered to allow her to remove her cottage or ' shack,and in view of all the circumatances,Mr.Taylorbs

  • attitude can only be regarded as extremely reasonable snd considerate. This evidence is,however,quite inconsistent with any warning to leave having been Aiven to defendant in terms of the sub-section under which this charge is laid, and even if it had been proved that such a warning had been properly givempit would still be necessary for the Court to be satisfied-that such warning had been given by the

owner or by some person authorised by or on behalf of the owner. Whatever the legal effect of the Proclamation may be, there is, of course,no power in this Court to determine the question of title which is raised bona Bide on this

  • charge,and the information must,therefore be dismissed.

*At the same time the defendant must clearly understand that she has no right to take the law into

her own hands,and she has /already been convicied and bound over on other charges. If the defendant desires to test the title or the Crown there are proper legal methods of doing so,nemely by an acticn in trespass in the Supreme Court or by such other method as she may be advised,but the defendant will only lay herself open to further penalties if she persists in her conduct towards the servants of the Dept."

The Deftence made a feature of the fact that the

The Engineer advises that the work is now proceeding on the block and he does not anticipate any further trouble.

-Ai To Rata a to Kawau Block.

With reference to your memo. of the 20th January last stating that you had received a petition from Peneti Hoani and five others (owners in the above Block) who in 1920 presented a similar petition to Parliament, praying for the return of the block, comprising 4* serge, which has been acquired under the Public Works Lot as a site for a stores depot, workshop, etc., in connection with the operations of the Land Drainage Branch of this Department at Werepeehi, I have now to\_inform you that, as you anticipated, the while of the block is required for land drainage operations and cannot therefore be returned.

I am adviseA that two of the six original owners have recently died, two are absentees and their objection to the taking of the land min be net by payment of compensation, another has offered her share to the Crown in exchange for other land, and Penete Boma maybe,' sentimental objections to the taking of the land, on the grounds that she has occasionally occupied one of the building' in the past, but she really suffers no hardship as her husband, Hewers. Taupe, owns several native blocks, whore the family resided until steps were taken to acquire the Ongarehu Block.

The building which Penete Hoani at present occupies is, I believe, about fifty years old, and is in a most delapidated and insanitary condition, and in the interests of public health, should be destroyed. The removal of the building would be a very costly undertaking, se the only sound portion is the brick chimney and further, the petitioner declares that she.will not consent to its removal.

The proposal to cut off three roods at the back of the property is contingent en access being provided by Reams of the existing private right of way, and this is under consideration.

If this right of way could be made appurtenant to the Bleck, it would be an alternative to the taking of the whole brook, and the natives would then retain the sound house, and the billiard room and whore, bat it is probable that this   d not meet the petitioners' objections and opposition to the remove or destruction of the old bones or shook, and under the circumstances, it is deemed necessary to retain the whole block.

the whole of the compensation money was paid over to the ':.aikatoManiapoto maori Land Board in the early part of 1922, and I am informed by the Registrar of the Board that the only persons who have not yel, received their money are makaurau Ripikoi, and the suocessors of Atareta to Hihi deceased, and Huatahi Hoani deceased.

Referring to-your memo of the 7th,August last re Judge McCormic's report on the above Block,I have to inform you that the Local .ngineer now advises that the Fative houses have been removed. As you are aware the Natives were given permission to remove the buildings though they will be paid their value in the compensation awarded by the Court.With the assistance of plant and gear lent them by the Department, the Latives\_have removed tae houses on to an adjacent Native Block ,where tney are oeing occupied as formerly.Tnis removes any possibility of hardship which might have been caused had the Natives lost the use of tnese buildings,and as this Department requires the whole of the Ongarehu Block for aepot and workmens' huts I cannot recommend that any portion of the land snould be returned to t.e Natives as suggested.   Past experience has proved that with native habitations on the Block it is impossible to keep the :iatives from wandering promiscuously about the depot buildings and yards, and in the interests of sanitation and health it is not desirable to have their habitations adjacent to the married workmens' quarters.

It has already been found necessary to extenttthe area occupied by the depot and consequently the space available for workers' accommodation has been considerably reduced. .   )g•marvas—oss

As far as I have been able to ascertain Peneti Hoani is the only

owner who objects to the acqlisition of this block by t:le Crown, and I am informed that this Native woman has interests in Kopuraruwai 3A2B, Horahia Opou 4B1B2B, and her husband has interests in Kopuarati 3C2B o.2 Makumaku 5A2D4B No.2,qorania apou 431B 1o.23 and Tiritiri No.5. The last mentioned block is at Kerepeehi and close to the Ongarehu Block.

Regarding the payment of compensation I enquired last April from the Native Land Court as to when the money would be paid over and was informed that the money had been paid into the sank New Zealand anti tnat the liatives could receive same on application through the :,ative Land Court.   -

Tnis,i take it,is a matter outside the province of this Department.

WHXREAB a Memorial of Ownership was ordered on the 22nd July 1860 by the Native Land Court to be issued in favour of certain Natives for the Ohinemuri No. 6

Block containing 200 acres and situated in Blocks XIII   •
and }(IV, Ohinemuri Survey District, Ohinemuri County, Anokkand Land District, aa the same was duly issued and -is registered in the Provisional Register Volume 32, folio 91, in the Auckland District Land Registry: And whereas the Crown has in error disposed of the said land in various parcels to Europeans as though it were Crown land, and it is necessary that such error should be .

rectified;   Be it therefore enacted as: follows; '   •

  1.   The Native Title to the said land is hereOY extinguished and the said land shall be deemed to have been vested in the Crown as from the date of the first disposition of any part of the said land by the Crown.

  2.  The Native Land Court is hereby authorised to ascertain in the same manner as if the said land had been taken under the Public Works Act, 1908, the amount of compensation payable to the Natives named in the Order of Memorial, or to their successors in title.

  3.  The District Land Registrar for the District of Auckland is hereby authorised to cancel the Certificate of Title, volume 32', folio 91, above mentioned.

As' you .are aware, the special Goverment valuation obtained for the 'Maori, land -was: .20/– ;per .011 or 'a:,–total–'of £365.• -The. block le surrounded 'by :Forest' land' and alma& say •:that; timber, exists' on the area -and, before -an offer Could' be made to. the- owner it 'would • be • necessary • for a valuation to-be made- ot any timber On' the block.

The land,- you will recall, has no* 'access sand is definitely considered unsuitable for- development. It apparently' is only suitable for Forest purposes and • the owner may be willing to sell at a reasonable figure...

Your memorandum of the 25th February 1954 to the Director of Forestry.

As directed this matter has been discussed with the Conservator and on the 28th April Mr.Wright saw the sole owner of Whangamata 6B1, Meeke to Moananui in Paeroa.

Meek°, like most Maoris of the day is not keen to sell.   However it was explained to him that the reason

the suggested exchange had been dropped was that it had been found that the Crown land being offered was not suitable for farm development. Likewise the lack of access and the unsuitability of the Whangamata Block for farming was explained. It was suggested that he should awboth blocks and then no doubt would be pleased to accept the generous offer being made to him.   Nevertheless it was explained that if, after viewing the blocks, he still wished to exchange the Crown would be prepared to negotiate on these lines. Mr.T.E.Stringer, District Ranger, New Zealand Forest Servi ce, was also present and explained that although there were two small clumps of young kauri riakers on the Whangamata Block there was no millable timber, and further that even if there were any worth while trees the difficulty of extraction would make their value practically negligible.

The final arrangement made was that Meeke would advise the Maori Welfare Officer, who was also present at the discussion, as to what he had decided. The Welfare Officer will notify me accordingly, and I will let you know the result.

With reference to your memorandum of the 24th March, I have.to advise that my District Ranger reports that the whole area was logged for kauri years ago and,with the exception of two areas of approximately one acre each, contains no standing timber.

The two acres referred to comprise of kauri ricers and could not be classed as milling timber and, in any ease, would have no commercial value owing to isolation and ruggednes of the country.

There is some kauri regeneration on the area but cove value is practically negligible and not worth taking into accou with two acres of native bush out of a total of 365 acres.
