PREFACE
There are twenty-eight parts to this volume as the 1,450 documents reproduced here amount to over 14,000 pages. These 28 parts collectively comprise the companion volume to The Hauraki Tribal Lands, Parts 1 - 4 by David Alexander. This volume contains all the reference material necessary to support that report.
The reproduction quality of some plans and deeds is at a lower standard than would normally have been expected. This is because reproduction at the A4 size contained in this part of the volume is a reduction from the much larger size of the original document. Also the general condition of the original document may have deteriorated over the years : ink or pencil lines have faded; pages have been ripped, torn or are missing, and in some instances they have been damaged by water, fire, mildew or insects. The detailed references which are provided enable the reader to check the original source document.
The index to all supporting papers is set out in the preliminary pages found at the beginning of each part of this volume. A user guide is also provided.

USER GUIDE
The Hauraki Tribal Lands Supporting Papers, Parts 1 to 28 are over 14,000 pages of documentation relevant to The Hauraki Treaty Claims, and in particular the work of David Alexander who has researched the history of approximately 700 blocks of Maori land. These were the original Maori land blocks that were alienated mainly to the Crown and in most cases were subsequently sub-divided many times to form the present day pattern of land ownership in Hauraki.
Each document has been given its own unique identifier and has been categorised according to document type and the block of land or subject it relates to.
There are 23 different types of documents which have been labelled Section A through to Section W. These comprise deeds, files, Maori Land Court Minute Book records, survey plans, Certificates of Title, Land Registry Documents, Turton's Publications, Appendices to the Journals of the House of Representatives, Parliamentary Debates and Gazette Notices.
A copy of the main index is included in each part. The main index is organised as follows:

Decision of Appellate Court (Judges Johnson & Edger) 6/8/01
In view of the positive statements- made by Mr Mackay; unshaken on cross-examination,that it was part of the agreement, made by him as agent of the Crown, with the Native Vendors,that the Crown should pay the cost of the surveys of the parts retained by the Natives, the Court feels bound to hold- that the Natives are not liable for the cost of any of these
surveys, so far as they are surveys of partitions made since.
and therefore refuse to make the Charging Orders asked
for.
It is true that Mr Mackaycould not shew authority in writing to make
such an agreement with the Natives,but the Court sees no reason to doubt-
his statement that he was often given a free hand to settle terms with
the Natives according to his own direction.
Though it is not now the Custom
to survey Reserves or other unsold parts free of cost to the Natives, such appears ta have been the general practice in earlier days, when also much smaller prices were paid for the land.

THE PETITION of the undersigned Aboriginal Natives of New Zealand resident in the District of Hauraki in the Provincial District of Auckland.
HUMBLY SHEWETH
THAT in or about the year 1867 certain Aboriginal Natives of the Colony of New Zealand for and on behalf of themselves and your Petitioners made and entered into an Agreement with one Daniel Pollen as Agent for the General Government of New Zealand granting the right to mine on certain lands then known as the Thames Goldfield in the vicinity of Grahamstown and Shortland.
IT was provided amongst other things by the said Agreement that no person should be permitted to mine on the lands in the said Agreement described being Native Lands unless he was the holder of a Miners Right empowering him in that behalf.
BY Section " 2 " of the said Agreement it was also provided that the payment for every such Miners Right should be the sum of One Pound per annum
UNDER the " Gold Mining Districts Act 1873 " a Miners Right covered an area of 159000 square feet which was called one man's ground whilst by the " Mining Acts of 1886 " & 1891 " and the regulations made thereunder and at present in force on the said Thames Goldfield one mans ground comprises 609000 square feet and thus only one Miners Right is now required where formerly four were
necessary.
BY subsec. No 5 of Sec. No. 10 of " The Mining Act Amendment Act No 2 1887 " it is provided that any person working for wages or on tribute need not necessarily be the holder of a Miners Right.
SUCH provisions in the said Mining Act 1886 and its amendments
are not in accordance with the terms embodied in the said Agreement.

GOLD MINING is carried on under Licenses granted under The Mining Act 1886 and previous Goldfields Acts upon Native lands the said Thames Goldfield by holders of Licenses and other workmen and Tributers who do not take out Miners Rights as formerly by 1and they were required to do.
BY Section 50 of " The Mining Act 1891 " it is provided that persons working on Native Land shall be the holders of Miners Rights but this Section is only applicable to persons working on land taken up and held under the Mining Act of 1891 and is not applicable to persons working on Native Land taken up for Mining Purposes under The Mining Act 1886 and the Goldfields Acts previous thereto.
BETWEEN the beginning of the year 1887(the time at which the provisions of the Mining Act 1886 came into force)and the end of the year 1894 the number of Miners employed on the said Thames Goldfield was 5000 or thereabouts while the number of Miners Rights of the value of £ 1 taken out during that period was 1000 or thereabouts.
UNDER Sec. 173 of the " Gold Mining Districts Act 1873 " all rents arising from Licensed Holdings under that Act were deemed to be moneys arising from Miners Rights and although the said rents are still paid to the Native Owners yet owing to the great reduction made by the said Mining Acts 1886 & 1891 in respect of rents from Licensed Holdings your Petitioners now receive only One Sixth of the amount reoeived.by them under the said Act of 1873.
LICENSEES under the said Act of 1873 by the provisions of the said Mining Acts 1886 & 1891 have the right to exchange their Titles and thus reduce their annual rents to a very small proportion of the former amounts payable as aforesaid
UNDER the provisions of the said Act of 1873 holders of Licenses were required to employ 3 men holders of Miners Rights to each acre of land held by them whilst under the Mining Act 1886 the Licensee is required to employ only one man for every two acres
2. and that man need not necessarily hold a Miners Right.

13. BY Sections 118 & 121 the area of Residence Sites was limited to one quarter of an Acre and the annual rent therefor One Pound but now by " The Mining Acts of 1886 & 1891 " the Area of Residence Sites has been increased to one Acre and the Rent therefor reduced to Five Shillings.
14. SIMILAR reductions have also been made in respect of rents and the number of men required upon Special Claims granted under Section 114 of the said Mining Act of 1886 & Section 66 of The Mining Act of 1891 And also in respect of Machine Site and Water Race rentals.
LARGE Areas of Native Land within the said Thames Goldfield have been taken up and held for considerable periods as Special Claims for speculative purposes & so prevented bona fide Miners from taking up & working the same ground as ordinary claims under Miners Right.
IN consequence of the several matters before mentioned your Petitioners have sustained a loss of Several Thousand Pounds.
THAT your Petitioners have frequently Petitioned Your Honorable House in reference to the several matters aforesaid and during the sitting of Parliament in the year 1894 the Native Affairs Committee made the following recommendation :-
That your Committee after careful consideration of the
documentary and other evidence at their disposal have come
to the conclusion that the Petitioners have sustained loss
through breach of the Agreement under which the Natives
consented to throw open this portion of the Goldfield for
gold mining purposes and recommend the Government to take
steps to ascertain the extent of the loss and recoup the
Petitioners.*
but no step has yet been taken to carry out the said
recommendation.

receiving only one pound now as against four then; and it was also urged that there was no proper supervision over the claims to ascertain whether every man working for example on a special or an extended claim is the holder of a miner's right.
There is no doubt that the Natives are equitably entitled to compensation for the losses sustained through breach of the agreement of 1867, and I think they would be prepared to accept e3000, or perhaps a little less, in full of all demands for the land and compensation for losses. Mr Sheridan recommends an offer of e2420.
Although the purchase of these lands may be a matter of policy, as a business transaction it has not much to recommend it. The Government will obtain no direct rettrn for the outlay. The revenue will be reduced by one-half, as the payment for .a miner's right on Crown lands is only half the amount paid on Native land, and this reduced revenue will, as now, be paid to the Local Bodies, the Government bearing the cost of collection.
